Newsday reported today that the NY State Supreme Court dismissed a lawsuit that we filed against Nassau County regarding the County designating certain members in "acting" titled positions", in other words making them managers. Supreme Court Judge Joel Asarch ruled that the Union was not specifically harmed as well as a host of other reasons. The Court did not decide that the County was in the right but in fact ruled that they could not decide the merits of the County's actions. As a result of Court's decision, we are exploring our appeal options and other legal recourse. One thing for certain is the importance of the new COBA by-law that was passed back in June 2012, which prevents this situation from occurring again with hard working members of our union.
